1. Introduction

Welcome to TheModularCity. These Terms and Conditions ("Terms") govern your access to and use of TheModularCity website (https://themodularcity.com) and application (https://app.themodularcity.com), including any content, functionality, and services offered on or through TheModularCity (collectively, the "Service").

Please read these Terms carefully before using our Service. By accessing or using TheModularCity, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Service.

2. Service Description

TheModularCity is a platform designed to help users plan and design LEGO® modular compatible cities. The Service allows users to:

  • Create and plan city layouts
  • Track progress of city changes and modifications
  • Plan upgrades such as switching from standard road plates to MILS (Modular Integrated Landscaping System)
  • Plan lighting kit installations
  • Customize sets used within cities

Future features may include the ability to add custom buildings with user-uploaded images and share public links to cities.

3. Account Registration

To access certain features of the Service, you must create an account using Google authentication. You agree to provide information about yourself such as your email address and name during the registration process.

You are responsible for safeguarding your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

Users may create and customize content within the Service ("User Content"). By creating User Content on TheModularCity, you grant us a non-exclusive, royalty-free, worldwide, transferable license to use, store, display, reproduce, and modify your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that:

  • You own the content you upload or have the right to use it and grant us the rights described above
  • Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights

5. Intellectual Property

5.1. Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of TheModularCity and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5.2. Third-Party Intellectual Property

TheModularCity may contain images of LEGO® sets. LEGO® is a trademark of the LEGO Group, which does not sponsor, authorize, or endorse this Service. Brand images of LEGO® sets are the intellectual property of The LEGO Group.

The 3D model images of LEGO® sets used within the Service are based on models from Mecabricks.com.

6. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To post, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, or otherwise objectionable
  • To share personal identifiable information of other persons without their consent
  • To promote gambling, terrorist organizations, or their names, slogans, and symbols
  • To engage in any conduct that restricts or inhibits anyone's use of the Service
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the servers on which the Service runs, or any servers, computers, or databases connected to the Service
  • To attack the Service via a denial-of-service attack or a distributed denial-of-service attack
  • To compromise the integrity of the platform or disrupt its service through technical hacking activities

7. Future Paid Services

Currently, TheModularCity is offered free of charge. However, we may introduce paid plans or premium features in the future. Should we introduce paid services:

  • We will clearly communicate the terms and pricing
  • You will not be automatically enrolled in paid services without your explicit consent
  • Additional terms may apply to paid services, which will be presented at the time they are offered

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, particularly the Prohibited Uses section.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the settings page.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THEMODULARCITY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION, RELIABILITY, OR AVAILABILITY OF THE SERVICE.

We do not guarantee that the Service will function without interruption or errors on all platforms, devices, and configurations. While we aim to provide the best functionality possible, the performance of the Service may vary depending on your device, internet connection, and other factors.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THEMODULARCITY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICE.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date at the top of this document.

It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which TheModularCity is established, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
